AN ORDINANCE ADOPTING THE OHIO HISTORICAL SOCIETY RECORDS RETENTION SCHEDULE FOR THE VILLAGE OF CHRISTIANSBURG, OHIO

 


WHEREAS, the Village of Christiansburg, Ohio, is required to maintain, preserve, and lawfully dispose of public records pursuant to Ohio Revised Code Sections 149.38 and 149.39; and

 

WHEREAS, the Ohio Historical Society has developed recommended records retention schedules for Ohio local governments; and

 

WHEREAS, Village Council finds it necessary to formally adopt a standardized records retention schedule;

 

NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Christiansburg, Ohio:

SECTION 1. ADOPTION

 

The Village of Christiansburg hereby adopts the records retention schedule recommended by the Ohio Historical Society, as attached hereto and incorporated herein by reference.

 

Said retention schedule shall govern the retention, preservation, and lawful disposal of Village records unless otherwise amended by law, ordinance, or resolution.

 

SECTION 2. SCOPE AND APPLICABILITY

 

This ordinance shall apply to all public records created, received, or maintained by Village officials, employees, departments, boards, commissions, committees, and contractors acting on behalf of the Village.

 

SECTION 3. RECORDS ADMINISTRATION

 

The Village Fiscal Officer shall serve as the Village’s Records Custodian. No records shall be destroyed except in accordance with:

 

• The adopted retention schedule
• Ohio Revised Code § 149.39
• Established Village procedures

 

All records disposal shall be documented. The Fiscal Officer shall maintain records of disposal as required by Ohio law.  Village Council shall serve as the Village Records Commission for purposes of records oversight and disposal authorization.

 

SECTION 4. CONFLICTING PROVISIONS

 

All prior ordinances, resolutions, policies, or practices inconsistent with this ordinance are hereby superseded to the extent of such conflict.

 

SECTION 5. SEVERABILITY

 

If any provision of this ordinance is declared invalid, such invalidity shall not affect the remaining provisions.

 

SECTION 6. EFFECTIVE DATE

 

This ordinance shall take effect and be in force at the earliest time permitted by law following passage.
